MOVEMBER GENERAL TERMS

This section sets out the terms that apply to your use of the Movember website and the Movember mobile apps (together, Services).  Your continued use of our Services indicates to Movember that you agree with these General Terms, as updated from time to time.  We may change these General Terms from time to time, so please check back regularly.
  1. Content created by Movember - Movember owns or license from third parties all of the trademarks, copyright and other intellectual property that exists in the Services.  You must not copy or reproduce in any form any of the graphics, logos or other material from our Services unless you have our specific permission.  For the avoidance of doubt, you have our permission to download material from the Downloads page on our website, subject to the restrictions noted on that page.
     
  2. Content posted by you - Any content that you post to our Services (eg photos, videos and comments) is your responsibility, and you must make sure that you have the necessary rights to post that content (eg by obtaining permission of copyright owners if necessary or by obtaining permission to use personal information of third parties).  By posting any content, you also give Movember a non-exclusive, transferable, royalty-free worldwide right to use and reproduce that content.
     
  3. Third party copyright infringement – Movember follows the provisions of the Digital Millennium Copyright Act and other relevant copyright legislation as applicable.  If you believe that someone else is using your copyright or trademark without your permission, please contact us at info.ie@movember.com to report the infringement.
     
  4. Respect the Mo Community – Stay respectful by adhering to the following:
     
    a. You must not collect user’s content using automated means
    b. You must not interfere with our website, upload viruses or other malicious code
    c. You must not bully, intimidate or harass anyone
    d. You must not post any content that infringes or violates someone else’s rights, or otherwise violates the law, or that is discriminatory, hateful, pornographic, threatening or violent
     
  5. Movember’s disclaimer – Movember takes great care with its Services and we endeavour to keep them accurate, error-free, and free of any offensive material.  However, you use the site at your own risk and Movember will not be liable for any costs or losses you incur through your use of our Services.  Whilst we may include on our Services links to third party websites or resources, Movember is not responsible for such third parties and you use those websites or resources at your own risk.
     
  6. Hosting a Movember Event – By registering to host a Movember Event, including any Move-style Event, you accept that you are responsible for the organisation and running of the Movember Event, which includes acquiring any necessary permits, permissions and/or insurance required to host such an event. There may be risks and dangers inherent to a Movember Event, and by choosing to host it you understand and accept that Movember will not have any liability in relation to any injury, damage or loss incurred in connection with your Movember Event.

  7. Participating in a hosted Movember Event – You acknowledge that if you participate in a Movember Event of any sort, including a Move-style Event, you do so at your own risk and that Movember will not have any liability in relation to any injury, damage or loss you suffer as a result.

  8. Your Move – Any Move challenges, events and activities (including any challenges you set for yourself) should only be undertaken with consideration given to your existing physical health, any medical conditions you may have and advice from appropriate health professionals. The information provided on this site, and any linked sites, is not a substitute for medical or professional care or advice particularly in relation to the suitability or safety of any given Move. Movember will not have any liability in relation to any injury, damage or loss related to your involvement in a Move challenge or activity.
     
  9. Movember Event RSVPs and Tickets – If you attend an official Movember Event, you will need to comply with any additional terms in the RSVPs, on the tickets and/or as notified to you by Movember prior to or at the Movember Event.
     
  10. Refunds – if you have made a donation in error, Movember is happy to refund you provided you notify Movember as soon as possible and in any event prior to the April 30 following receipt of your donation (eg for a donation made November 2016, notification is required by 30 April 2017; for a donation made in May 2017, notification required by 30 April 2018).  If you wish to request a refund then please contact us using the contact details in the Contact Us section of the Movember website relevant to the country in which you live.

  11. Movember’s rights - Movember may remove any content posted by you, or prevent access by you to our Services at its entire discretion.  Any failure by Movember to enforce our rights under these General Terms is not a waiver and we remain entitled to enforce our rights.

  12. Entities and governing law – the Movember entity and relevant law governing these General Terms depends on the country in which you live:

    a. If you live in the USA, these General Terms form an agreement between you and Movember Foundation subject to the laws of California, USA;
    b. If you live in Canada, these General Terms form an agreement between you and Movember Canada, subject to the laws of Ontario, Canada;
    c. If you live in the UK or a country that forms part of the EEA (except for Germany), these General Terms form an agreement between you and Movember Europe, subject to the laws of England and Wales;
    d. If you live in New Zealand, these General Terms form an agreement between you and the Movember Foundation New Zealand, subject to the laws of New Zealand;
    e. If you live in Germany, these General Terms form an agreement between you and Movember Foundation e.V, subject to the laws of Germany; and
    f. If you live in Australia, or in any other place not covered by paragraphs a, b, c, d or e above, these General Terms form an agreement between you and The Movember Group Pty Ltd as trustee for the Movember Foundation, subject to the laws of Victoria, Australia.



Prizing Terms and Conditions



Survey competition
  1. This competition is open to all Mo Bros and Mo Sistas registered at Movember (movember.com), except employees and related parties of Movember.

  2. To be eligible to win, you must submit a valid entry by 09:59:59:59am on December 16, 2016 (Australian Eastern Daylight Savings Time).

  3. A valid entry requires the satisfactory completion of two (2) customer experience surveys.

  4. Entrants must be registered as a Mo Bro or Mo Sista on the relevant Movember website in their country of residence. This competition is open to Mo Bros and Mo Sistas who are residents in Australia, New Zealand, United States of America, United Kingdom, Ireland and Canada.

  5. Each registered Mo Bro or Mo Sista is eligible for a single entry only.

  6. Any entry not complying with these terms and conditions will be deemed invalid and Movember reserves the right to verify the validity of entries and to disqualify any entrant for submitting an entry which is incomplete, not in accordance with these terms and conditions or who tampers with the entry process.

  7. The winners will be determined by Movember HQ based on the creativity of the response to the final survey question in the second survey telling us in 50-words of less ‘what you love about Movember’.

  8. The decision of Movember HQ is final and no correspondence will be entered into.

  9. There are ten (10) prize packages to be won. Each package consists of a boost to the winner’s Mo Space fundraising total, with the amounts dependent on the country of residence of the winner:
    If the winner is resident in Australia, the prize will be AUD $50;
    If the winner is resident in New Zealand, the prize will be NZD $50;
    If the winner is resident in Canada, the prize will be CAD $50;
    If the winner is resident in the United States of America, the prize will be USD $40;
    If the winner is resident in the United Kingdom, the prize will be GBP £30; and
    If the winner is resident in Ireland, the prize will be EUR €35.

  10. The prize package is not redeemable for cash or other products and is not transferable.

  11. Movember reserves the right to substitute alternative prizes if necessary due to unavailability of the notified prizes.

  12. The winners will be notified by email by December 22nd, 2016 and the relevant prize will be awarded to the winner’s Mo Space fundraising page by December 22nd 2016 (AEDT). The name of the winners will be published on the website www.movember.com and awards.movember.com by December 22nd, 2016.

  13. If for any reason this competition is not capable of running as planned, then subject to any compulsory law to the contrary Movember reserves the right to cancel the competition.

  14. All entries become the property of Movember. All information contained in the entries and details of the winner will be held in accordance with the Movember Privacy Policy, which can be accessed by visiting www.movember.com.


€25 Prize Draw
  1. This prize draw is applicable to all Mo Bros and Mo Sistas registered at Movember Ireland (ie.movember.com), except employees of Movember and their immediate family members and related parties, who have raised €25 or more by 10:00:00pm (GMT) December 8, 2016. Registrations or donations received or processed after 10:00:00pm on December 8, 2016 (GMT) will not qualify.

  2. Mo Bros and Mo Sistas who register at ie.movember.com and raise €25 or more for Movember are automatically entered into the prize draw and notified of this by Movember via email. One entry per person per €25 raised up to €200 (i.e max 8 entries per person).

  3. Movember shall not be responsible for any technological issues that prevent any donations being processed or that cause a disparity between the time the donation is recorded on the Movember system and the time submitted or shown on your donation receipt. In order to avoid any disappointment, please submit all online donations in good time to ensure that they are processed before the cut-off. Please also ensure that any offline donations (such as cash or cheques) have been submitted to Movember in good time to be processed and included in your donation total. Movember’s decision is final.

  4. Movember reserves the right to verify the validity of entries and to disqualify any entrant who tampers with the registration, donation or entry process.

  5. Two winners will be determined by random electronic draw from all valid registrants and 12 winners will be selected in total. This will take place at approximately 3:00:00am on December 9, 2016 (GMT) at the premises of Movember HQ in Melbourne, Australia.

  6. The two winners will be notified by email on or before 12 December 2016. The name of winners may be published on Movember’s website and may be included in any prize announcement e-mail.

  7. All prizes are as stated below, are not redeemable for cash or other products and are non-transferable. Prizes can only be claimed by verbal or written acceptance of the winner or someone authorised on their behalf. Movember reserves the right to substitute alternative prizes if necessary due to unavailability of the notified prizes.

  8. If the prize is not claimed by 31 December 2016 the prize will be forfeited and may be awarded to another valid entrant drawn randomly or may be withdrawn.

  9. The Prize for each winner is a piece of the Windmill Lane wall – the two winners will each get a piece of the iconic Dublin music and art scene venue knocked down in 2015. (restrictions may apply)

  10. If for any reason this competition is not capable of running as planned, then subject to any compulsory law to the contrary Movember reserves the right to cancel the competition.

  11. All personal information submitted or held in connection with the draw will be processed in accordance with Movember’s Privacy Policy, available at www.movember.com.

The Platinum Club Award
  1. The Platinum Club is applicable to all Mo Bros and Mo Sistas registered at Movember Ireland (ie.movember.com), except employees of Movember and their immediate family members and related parties, who raise €1000 or more by 10:00:00pm (GMT) December 8, 2016. Registrations or donations received or processed after 10:00:00pm on December 8, 2016 (GMT) will not qualify.

  2. All Mo Bros and Mo Sistas who register at ie.movember.com and raise €1000 or more for Movember will automatically win the 2016 Platinum Club Prize and will be notified of this by Movember via email. Club entry is limited to one per registrant.

  3. Movember shall not be responsible for any technological issues that prevent any donations being processed or that cause a disparity between the time the donation is recorded on the Movember system and the time submitted or shown on your donation receipt. In order to avoid any disappointment, please submit all online donations in good time to ensure that they are processed before the cut-off. Please also ensure that any offline donations (such as cash or cheques) have been submitted to Movember in good time to be processed and included in your donation total. Movember’s decision is final.

  4. Movember reserves the right to verify the validity of entries and to disqualify any entrant who tampers with the registration, donation or entry process.

  5. Platinum Club Membership is awarded automatically on raising €1000 on or before 10:00:00pm and each 2016 Member will be awarded the Platinum Club Prize.

  6. Winners will be notified by email within two weeks of close. The name of winners may be published on Movember’s website and may be included in any prize announcement e-mail.

  7. All prizes are as stated below, are not redeemable for cash or other products and are non-transferable. Prizes can only be claimed by verbal or written acceptance of the winner or someone authorised on their behalf. Movember reserves the right to substitute alternative prizes if necessary due to unavailability of the notified prizes.

  8. If the prize is not claimed by 31 December 2016 the prize may be forfeited and may be awarded to another valid entrant drawn randomly or may be withdrawn.

  9. The 2016 Platinum Club Prize awarded to every 2016 platinum club member is an exclusive Movember pocket compass;

Team Mo Award (fewer than 11)
  1. This competition is applicable for Teams of fewer than 11 Mo Bros and Mo Sistas registered at Movember Ireland (ie.movember.com), except employees of Movember and their immediate family members and related parties.

  2. The winner is the Team with fewer than 11 members, that has raised the greatest amount of money for the 2016 campaign based on the donation totals listed on ie.movember.com as at 10:00:00pm (GMT) December 8, 2016. Registrations or donations received or processed after 10:00:00pm on December 8, 2016 (GMT) will not qualify.

  3. Movember shall not be responsible for any technological issues that prevent any donations being processed or that cause a disparity between the time the donation is recorded on the Movember system and the time submitted or shown on your donation receipt. In order to avoid any disappointment, please submit all online donations in good time to ensure that they are processed before the cut-off. Please also ensure that any offline donations (such as cash or cheques) have been submitted to Movember in good time to be processed and included in your donation total. The winner is the Team with 11 or more members, that has raised the greatest amount of money for the 2016 campaign based on the donation totals listed on ie.movember.com as at 10:00:00pm (GMT) December 8, 2016. Registrations or donations received or processed after 10:00:00pm on December 8, 2016 (GMT) will not qualify.

  3. Movember shall not be responsible for any technological issues that prevent any donations being processed or that cause a disparity between the time the donation is recorded on the Movember system and the time submitted or shown on your donation receipt. The Winner is the individual Mo Bro or Mo Sista (registered as a team member or solo) that has the most awesome Mo-Space page evidences by total facebook likes listed on ie.movember.com as at 10:00:00pm (GMT) December 8, 2016. Registrations or likes received or processed after 10:00:00pm on December 8, 2016 (GMT) will not qualify;

  3. Movember shall not be responsible for any technological issues that prevent any likes being processed or that cause a disparity between the time the like is recorded on the Movember or facebook system and the time submitted or shown anywhere else. In order to avoid any disappointment, please submit all likes in good time to ensure that they are processed before the cut-off. In the event of a tie, Movember will judge the best space in its absolute discretion and Movember’s decision is final;

  4. Movember reserves the right to verify the validity of entries and to disqualify any entrant who tampers with the registration, donation or entry process;

  5. The Winner will be notified by email on or before 12 December 2016. The name of the winning individual may be published on Movember’s website and may be included in any prize announcement e-mail;
